1. What documents does a favorable divorce need?
When either spouse or both spouses realize that their marital relationship cannot continue to last anymore, marriage life and the purpose of marriage cannot be extended, couples often choose to negotiate a divorce.
What documents does a favorable divorce need in 2021?
In Article 55 of the Law on Marriage and Family 2014, the divorce agreement is recognized by the Court when meeting the following conditions:
- Husband and wife with the same will to request the competent court to settle the divorce voluntarily.
- The two parties agreed in the petition for consyment of divorce on related issues such as the division of property of husband and wife, custody of husband and wife, support for children on the basis of ensuring legitimate rights in accordance with the law of wives and children;
- To be recognized by the competent People's Court for the consent of divorce.
According to the provisions of the Civil Procedure Code 2015, specifically in Clause 2, Article 29, the divorce agreement should have the following dossiers and papers:
- Petition for consent for divorce (signed by both spouses);
- Certificate of marriage registration of husband and wife (original). If there is no hold or no original marriage registration certificate, the people's committees of the communes where the marriage registrations are registered may extract copies;
- Household book of the family (01 certified copy);
- Joint child's birth certificate (if any, 01 copy);
- Documents related to the couple's debts (if any). For example, a certificate of land use rights (01 noted copy), loan papers or loans...
