1. Land use term for rice cultivation
Based on Clause 1 of Article 126 of the Land Law 2013, the term of agricultural land use in general and the term of use of rice land in particular for individuals and households meeting the conditions directly produced on rice land is 50 years.
On the other behalf of Clause 3 of Article 210 on the transition and enforcement effect of the Land Law 2013, the subjects are individuals, households directly cultivating and using agricultural land groups in general and rice-growing land in particular which have been assigned land, recognizing land use rights before the effective date of the Land Law 2013 (before July 1, 2014), when the time limit for continued use is continued in accordance with Clause 1, Article 126 of this Law if necessary.
2. Can the land for rice cultivation expire?
When the land for rice cultivation expires at the maximum shelf life of 50 years as stipulated in Clause 1, Article 126 of the Land Law 2013, when this time limit expires, for individuals and households still wishing to use the land for production, they may continue to use the land according to the time limit specified in this Clause.
On the other sex, as stipulated in Clause 2, Article 74 of Decree No. 43/2014/ND- CP, individuals and households when the land for rice cultivation expires in the shelf life of 50 years, the land use is continued according to the above-mentioned time limit without the need for procedures related to the adjustment of the contents of the land use term. In case individuals and households wishing to re-determine the land use term on the certificate of land use rights for rice cultivation, the procedures prescribed in Clause 3, Article 74 of Decree No. 43/2014/ND-CP.
